In this post we will go through the rules and regulations of overtime calculation in UAE.

1. What is Overtime?

Overtime means the extra hours an employee works beyond the regular working hours mentioned in their employment contract. UAE Labour Law has the maximum number of overtime hours an employee can work in a day to protect the workers and prevent exploitation.

2. Maximum Overtime Hours

According to UAE Labour Law, an employee can work maximum 2 hours of overtime in a day. Employers cannot ask or force employees to work beyond this limit except in exceptional cases where there is an emergency like unexpected situations.

3. Overtime Pay Calculation

UAE Labour Law has a simple and uniform way of calculating overtime pay. Employees who work overtime are entitled to their regular pay for the normal working hours which is based on their basic salary. And they will get an additional 25% of their regular pay for the overtime hours worked.

4. Night Shift Overtime

Let’s say an employee has a basic salary of 2500 AED and hourly rate calculated based on their basic salary and total normal working hours.

The employee works 3 hours of overtime between 10 pm to 4 am:

Hourly Rate = (2500 ÷ (48 * 5)) ≈ 10.42 AED per hour

Overtime Pay = (10.42 × 3) + (10.42 × 0.5 × 3) ≈ 36.26 AED

In this example, the employee will get an additional 36.26 AED for the 3 hours of night shift overtime as per UAE Labor Law. Employers should take care of workers during night shifts by providing fair compensation as encouraged by the night rate.

5. Overtime Exemption for Shift Workers

Shift workers are exempt from overtime rules. UAE Labor Law recognizes the nature of shift work and has separate provisions for workers who work in shifts.

6. Rest Day Overtime

If an employee has to work on their rest day, they will get either a substitute rest day or pay equal to their basic salary for the working hours plus 50%. So employees who give up their days off are compensated for their sacrifice.

Overtime Pay = (Hourly Rate × Overtime Hours) + (Hourly Rate × 1.5 × Overtime Hours)

Example with 2500 AED Basic Salary:

Let’s say an employee has a basic salary of 2500 AED and an hourly rate calculated based on their basic salary and total normal working hours.

The employee works 5 hours on their rest day:

Hourly Rate = (2500 ÷ (48 * 5)) ≈ 10.42 AED per hour

Overtime Pay = (10.42 × 5) + (10.42 × 1.5 × 5) ≈ 83.36 AED

In this example, the employee will get an additional 83.36 AED for the 5 hours of overtime worked on their rest day as per UAE Labor Law.
